Unfortunately for Disney, contracts are enforceable even if there are adverse events, unless those are covered in the contract in some way. Also, it’s on Disney if they did not have insurance as well for such things as a pandemic. Scarlett is perfectly correct to sue them — one has no duty to be nice to a corporation, nor one should be in my opinion. She knows (like anyone sane should) that Disney or any corporation would totally screw you over given the slightest opportunity or excuse.
The statement by Disney has no legal basis or legal import at all. It was designed as a subtle smear against her, to stain her image in the public mind and has nothing to do with contract law. An actual court will decide the matter based on the contract itself.
